Upon approval of this application, Pacific Cellular Supply Inc., in its sole discretion
will assign you, the applicant, a maximum credit line. PCS Inc. shall have the right
to increase, decrease, hold or terminate any applicant’s credit privileges under
this application at any time without prior notice to the applicant except as otherwise
provided by law. All amounts are due and payable in U.S. Funds. All orders are subject
to approval. Shipments must be prepaid outside the United States of America. Customers
with late payments or returned checks will be changed to cash only. When applicable,
all legal and collection costs may be added to customer account balance up to the
maximum allowed by law. There is a $25.00 handling charge for all returned checks
for any reason.
A charge
of $3.00 is added to each drop-shipment. All orders will be shipped freight collect
F.O.B. our warehouse, unless prearranged and approved. All shipments are via ground
transportation, unless request is by written, prior authorization from the buyer.
All claims for incorrect shipments must be received within seven (7) days from the
date of invoice. There will be a 20% restocking fee for all non D.O.A items. Defective
products may be returned for credit only by obtaining a Return Authorization (R.A.).
All returned products must be received at PCS no more than thirty (30) days after
date of invoice, with a copy of the original invoice from which the items were purchased.
In consideration of credit being extended by Pacific Cellular Supply, Inc. to the
above named applicant, whether the applicant be a proprietorship, a partnership,
a corporation, or other entity, the undersigned guarantor(s), whether personally
for a Proprietorship, or as an officer duly authorized to obligate and bind their
corporation, each hereby contract and guarantee to Pacific Cellular Supply, Inc.,
the faithful payment, when due, of all accounts of said applicant for purchases
made from Pacific Cellular Supply, Inc. The undersigned guarantor(s), each hereby
expressly waive all notice of acceptance of this guarantee, notice of extension
of credit to applicant, presentment, and demand for payment on the applicant, protest
and notice to undersigned guarantor of dishonor or any default by applicant, or
with respect to any security held by Pacific Cellular Supply, Inc., any extension
of time payment to applicant, acceptance of partial payment or partial compromise,
all other notices to which the undersigned guarantor or guarantors might otherwise
be entitled and demand for payment under this guarantee.
